Privacy and security is at the core of everything HitSend endeavors to achieves. By proceeding to use or access the HitSend platform in any way, your usage acknowledges that you accept the practices and policies as described below. This gives HitSend consent to collect and use your information for business purposes as described in this Privacy Policy.


Please also refer to the HitSend Terms of Service which serves inconjunction with this Privacy Policy as notice for consent when using the HitSend platform.

Account Information

Personal information that is provided by you when signing up for a HitSend account includes first name, last name, email address, account name, profile picture and password. This information is stored solely for the purpose of providing the best user experience and is not shared to 3rd party vendors in any way.

Files

Your files that you or your clients/collaborators upload are stored, processed, and transmit as well as information related to it. This related information includes your profile information that makes it easier to collaborate and share your files, projects and ideas with others, as well as things like the size of the file, the time it was uploaded, collaborators, and usage activity.

Contacts

Contact access may be allowed if you choose so to make it easy for you to do things like share and collaborate on projects and invite others to use our Service.

Transactional Information

Transactional information such as billing information and payments using integrated payment systems are kept, but no credit card numbers or bank account numbers are recorded or stored by us.

Feedback and Correspondence

Feedback and correspondence that you provide when reporting a problem with our Service to customer service or other correspondence may be kept.

Usage Information

Usage information is collected that relates to how you use the Services, including actions you take in your account such as sharing, editing, playing audio, creating and moving files or folders. This includes information associated with any content uploaded to the Site or information given by using any features of the Service. We use this information to improve and promote our Services.

Device Information

Device information that are used to access the Service including things like your IP address, web browser, screen resolution, how long you stay on pages, type of device, what website you came from, and general location.

Cookies and Other Technologies

Cookies and other technologies are used to provide, improve, protect and promote our service. You can set your browser to not accept cookies, but this may limit your Service. We may also use third party pixel tags to collect information and you can learn more about these technologies and how to opt out of them here.

Retention of Information

Retention of information will continue on our servers as long as your account exists, or as long as we need it to provide you the Service. If you do delete your account, we’ll initiate a deletion of your data after 30 days. There may be some delays in deleting information from backup servers and if any information is needed to comply with legal obligations, to resolve any open disputes or enforce agreements.

Processing Your Data

Processing your data described above is in order to ensure that the Service provided to you is secure and reliable. We also collect and use personal data for our legitimate business needs, and will ask permission in advance to process your personal data for other purposes.

European Union Data Subject Rights

European Union data subject rights may provide residents of the European Union (“EU”), United Kingdom, Lichtenstein, Norway or Iceland, may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data.  We use the terms “Persona Data” and “Processing” as they are defined in the GDPR, but “Personal Data” generally means information that can be used to individually identify a person, and “processing” generally covers actions that can be performed in connection with data such as collection, use, storage and disclosure.

California Residents

California residents have the right to request information about our collection and use of your Personal Data over the past 12 months under CCPA. If we have disclosed any of your Personal Data to third parties for a business purpose over the past 12 months, we will identify what information was shared. To submit a request you or an agent must submit a request that provides sufficient information pertaining to your account credentials in order to verify who you are, and describes your request well enough for us to understand, evaluate, and respond. Request must meet both requirements above in order to be considered a valid request, and we may not respond to requests that don’t meet these regulations. We will not discriminate against you for using your rights under CCPA, deny you goods or services, or charge you any different rates or quality of goods. Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Data to third parties for direct marketing purposes. Nevada Residents

Nevada Residents are subject to Personal Data as defined in Revised Statutes Chapter 603A.  If you are a resident of Nevada, you also have the right to opt-out of the sale of certain Personal Data to third parties who intend to license or sell that Personal Data. Please do understand, we do not currently sell, trade, or otherwise distribute your information.

Conflicts

If there are any conflicts between this section and any other provision of this Privacy Policy and you are a California resident, the portion that is more protective of Personal Data shall control to the extent of such conflict.

Sharing Information

Third Party Access and registration is possible through integrated services such as Google, API connections or other similar integrated services. By doing so, you’re allowing HitSend and those third party services to exchange information about you and data in your account so that HitSend and those third parties can provide, improve, protect, and promote their services. Please do remember that third parties’ use of your information will be subject to their own privacy policies and terms of service.


Service Providers may perform tasks such as IT support or customer service on our behalf. These third parties may use your information only under our direction and in accordance with this privacy policy.


Created Content to be shared may occur while using HitSend through items such as comments and file uploads. For your safety please do not imbed any sensitive personal information in your content to be shared with any other users or else that information you share online becomes public information and can be collected and used by others which may result in unsolicited contacts from others.


Information Locations for storing and processing data are located around the world and may include locations outside of your country where the data protection laws and regulations may differ. Information can also be stored on your local device that you use to access the Service. All transfer of data is in compliance with the EU-U.S. Privacy Shield This is done to ensure you have the best reliability and secure Service. In compliance with the Privacy Shield Principles, HitSend wills to resolve complaints about our collection or use of your Personal Information. EU individuals with inquiries or complaints regarding our Privacy Shield policy should first contact HitSend at privacy@hitsend.io. We may share information as discussed above, but we will never sell it to advertisers or other third parties.

Referrals

Referrals from current users of our service may be sent out to friends or other contacts inviting them to use the Service. If you are an existing user, you may only send a referral if you have permission to do so by your contact. We may also receive your information if you submit it to a third party as part of a promotional event sponsored by HitSend, and when you submit the information to these third parties that gives us the right to contact you about these promotional events.

Security

Security is a continued commitment by us as we continually run test to ensure your personal information is secure and to detect any vulnerabilities. We deploy automated technologies to detect abusive behavior and content that may harm our Services, you, or other users. You should also help protect your data by creating strong passwords and sign-ins, limit the access points to the Service, and sign off after you have finished accessing your account. Although we work to protect the security of your account and other data, please be aware that no method of transmitting or storing data is completely secure.

Children

Children under the age of 16 are not knowingly contacted or solicited for the collection of any data. If you are a child under the age of 16, please do not attempt to register for an account or submit any personal data. If we learn we have collected any information from a child under the age of 16, we will delete that information as quickly as possible.

Access and Change Personal Data in your account settings as well as manage your account.

Changes

If we’re involved in a reorganization, merger, acquisition, or sale of our company and your data may be transferred as part of that deal, we will notify you and outline your choices.
